Respondent Judge Teofilo D. Baluma dismissed a criminal case for child abuse on the basis that the information was not subscribed and sworn to by the prosecutor. However, the rules do not require an information to be sworn to - only that it be in writing and subscribed by the prosecutor. While the judge rectified his error later, he is still found to have violated the Code of Judicial Conduct due to his failure to understand this elementary rule of law.
