The Supreme Court ruled that the second sale of property by Eulalio Cueno to Luis Bautista without the consent of his wife Flora was not void but voidable. While Article 166 of the Civil Code requires spousal consent for the sale of conjugal property, Article 173 states that such transactions are voidable if challenged within 10 years, not void. The Court held that even though Flora did not consent to the second sale, it was merely voidable and not void since respondents were innocent third-party purchasers
