The Supreme Court ruled that the 5% tax imposed by Quezon City on the gross receipts of stall rentals at the privately owned Farmers Market was a valid license fee, not an unconstitutional income tax. While the petitioner claimed the tax was essentially an income tax prohibited by law, the Court found that operating a public market requires a license from the city in the exercise of its police power. As such, the 5% fee was a legitimate charge for the regulation of the petitioner
