The BIR did not act on the claim. 2) The CTA First Division found that Cebu Holdings was entitled to a tax credit of around 2 million pesos for excess taxes paid in 2002, but some amounts claimed were filed outside the period. 3) The Supreme Court ruled that Cebu Holdings complied with requirements for a tax credit and ordered the BIR to issue a tax credit certificate for 2 million pesos for taxes paid in 2002.
