The defendant was convicted in 1937 of kidnapping, bank robbery, and motor vehicle theft based on guilty pleas. He was not advised of his right to counsel. In 1939 he was released via habeas corpus and returned to Pennsylvania where he was appointed counsel. He was then tried by jury and convicted of kidnapping and motor vehicle theft. He was sentenced to life for kidnapping and 5 years for the theft. In 1957 he filed a motion under 28 U.S.C. § 2255 to vacate the convictions and sentences. The court denied
