Abstract The federal and state governments pass laws to protect public health. However, the authority of government is not unlimited. In this chapter, we discuss how the Constitution guarantees certain rights to the people and review how these rights impact the practice of public health. The chapter primarily focuses on those rights secured by the Bill of Rights, but notes that the constitution of each state also grants individual rights, which in some cases are broader than those recognized federally.
