The Supreme Court affirmed the conviction of Rex Sorongan for estafa under Article 315(1)(b) of the Revised Penal Code. Nelly Van der Boom accused Sorongan of borrowing a cement mixer worth PHP 25,000 from her and failing to return it despite demands. However, the Court found Sorongan not guilty as the elements of estafa were not present - before filing the criminal case, Nelly had already renounced her ownership of the cement mixer, so there was no property entrusted or misappropriated.
