Dario Nacar was dismissed from his job at Gallery Frames without just cause in 1997. He was awarded damages of 158,919.92 pesos by the Labor Arbiter, but sought a re-computation of damages during execution of the final judgment to include amounts owed until the final judgment date of 2002. The Supreme Court ruled that a re-computation does not violate immutability of judgments, as the ruling on illegal dismissal stands while the damages computation can be altered.
