The Supreme Court ruled that the COMELEC acted without jurisdiction or with grave abuse of discretion when it resolved election appeals in several special cases without first referring them to its Divisions, as required by the Constitution. The resolutions of the COMELEC en banc are therefore null and void. The appeals are deemed pending before the COMELEC for proper referral to a Division in accordance with the rules. The petitions were dismissed without prejudice to filing regular election protests.
