KARL MEESSEN:\* I would by no means expect foreign corporations to be cleared from the impact of U.S. antitrust law if the proposed jurisdictional amendments were adopted. The balancing test, however, should not be put into the straitjacket of statutory regulation. At any rate, if those regulations do not cover the particular case, recourse to the more general principle of balancing should still be permitted as it was during the last 20 years of largely successful U.S. case law on matters of extraterritoriality. The impediments to business development that Mr. Reeves covered work against European companies just as well as against non-European MNEs. Labor laws that punish disinvestment when a business is failing hurt European firms, too. Mr. REEVES: I was trying, during my brief presentation, to discuss the problems facing both European multinationals and multinationals foreign to the European Common Market. Even so, the difficult business environment in Europe may actually be creating some good opportunities; with 200 million people, the European market should not be neglected in spite of the added difficulty of doing business there.
