Ivler was charged with reckless imprudence resulting in slight physical injuries and reckless imprudence resulting in homicide for a vehicular collision. Ivler pleaded guilty to the slight physical injuries charge. The court held that reckless imprudence under Article 365 is a single quasi-offense penalizing the negligent mental state, not separate offenses for each result. Therefore, Ivler could not be prosecuted for homicide as well, as that would violate double jeopardy. Article 48 on complex crimes also
