Mercury Drug Corporation and its pharmacist assistant Aurmela Ganzon were found liable for damages caused to Raul de Leon when the wrong medicine was dispensed. Ganzon negligently gave De Leon ear drops instead of the eye drops prescribed. While De Leon was also negligent, the court held that Mercury Drug and Ganzon, as experts in pharmacy, failed to exercise the highest degree of care expected. Their negligence was the proximate cause of the damages. The Court of Appeals affirmed this decision.
