The Regional Trial Court convicted Lagarto of murdering Reynaldo Acudal on May 25, 1983. Lagarto had already been convicted of homicide in a prior case. The Supreme Court ruled that the requirements of recidivism were met, as Lagarto was convicted of a new crime while already convicted of a previous crime under the Revised Penal Code. The Court held that the lower court correctly found recidivism and properly aggravated the crime.
