On 15 December 2003, two Informations for rape and one for acts of lasciviousness were filed against petitioners Darryl Hipos, Jaycee Corsiño, Arthur Villaruel and two others. Private complainants later filed a Motion for Reinvestigation which Judge Bay granted, ordering the City Prosecutor to study if the proper Informations had been filed. On 19 May 2004, petitioners filed a Joint Memorandum to Dismiss the Cases claiming no probable cause. On 10 August 2004, the City Prosecutor affirmed the Informations.
