1) Agripino Neri y Chavez had 11 children from two marriages. When he died in 1931, he left a will that omitted his children from his first marriage. 2) The Supreme Court ruled that this omission, or preterition, of the forced heirs from the first marriage voided the institution of heirs in the will. 3) As there were no express legacies or betterments in the will, intestate succession applied and all 11 children were found to be intestate heirs of Agripino Neri y Chavez.
