The Board of Immigration Appeals found Kawee Lauvera deportable for being convicted of credit card fraud for which he was sentenced to up to 5 years in prison. The court affirmed this ruling and also found that Lauvera did not qualify for asylum or withholding of deportation as he did not demonstrate a well-founded fear of persecution if returned to Thailand. Additionally, Lauvera was not eligible for a discretionary waiver of deportation as he was not a lawful permanent resident of the United States.
