What is Motion to Dismiss Traffic Charge in IL about?
When charged with virtually any traffic offense there is a failure of the police to state the "nature of the offense" as required by statute. This motion moves the court to dismiss the charge for failing to meet the statutory requirements of an "offense". This motion, coupled with my other motion for Verified Complaint is a substantial hurdle which the State must overcome to properly charge the offense..... which they seldom, if ever, do.
