The RTC correctly ruled that Sections 13 and 14 of RA 9167 are unconstitutional. 1. RA 9167 violates the local fiscal autonomy of cities and municipalities by transferring the proceeds of amusement taxes levied by local governments to the Film Development Council of the Philippines (FDCP) rather than allowing the revenues to accrue to the local governments themselves. 2. Under the constitution and existing laws, local governments have the authority to levy amusement taxes on cinemas and theaters. RA 9167
