Petitioner Jacinto was convicted of qualified theft for depositing a check meant for her employer, Megafoam International, into her personal account. The Supreme Court modified the conviction, finding that while Jacinto had criminal intent, the crime of theft was impossible to commit as the check was unfunded. While Jacinto intended to unjustly enrich herself, the check ultimately had no value. The Court found Jacinto guilty only of the impossible crime and sentenced her to 6 months of arresto mayor.
