Joaquin Herrer applied for a life annuity with Sun Life Assurance Company of Canada through their Manila office. While the home office in Montreal approved the application and issued a policy, the local Manila office claims to have sent a notification letter on November 26th, but it was never proven to have been received by Herrer. Herrer died on December 20th, before any notice of acceptance. The court ruled that under the Civil Code, acceptance of an offer for insurance is not complete until notification
