A restaurant called Pizza of Gaithersburg Inc. (PG) contracted with Virginia Coffee Service (VCS) to have vending machines installed for one year, automatically renewable unless PG provided 30 days notice. After one year, VCS was sold to Macke Company, including the PG contract. PG canceled due to the change in ownership. Macke sued PG, claiming the contract was delegated, but PG argued it was a personal service contract and non-assignable.
