1) Petitioner Ildefonso Cervantes began possessing land in 1944 and filed for a free patent in 1958. In 1976, his nephew Moises Madarcos convinced him to amend the application, and Cervantes signed a quitclaim relinquishing part of the land to Madarcos. 2) Madarcos then applied for and was granted a free patent for the land based on the quitclaim. He was later issued a certificate of title in 1977. 3) Cervantes discovered this in 1979 and demanded an explanation. He filed a case for reconveyance in 1987,
