One night in 1932, Yu Lon and Yu Yee were talking on the sidewalk when a man passed by them twice. When Yu Yee went to leave, the man struck Yu Lon from behind on the head. Yu Lon fell and hit his head on the pavement, dying at the hospital around midnight. It is argued the appellant should be punished for slight physical injuries instead of murder.
