Vinay Kumar v. Nirmala54 was a case where the wife was unable to adjust with her husband and in-laws, she was abusive and violent towards them, even threatening to set the matrimonial house on fire. She then left and did not return. Based on her conduct while living there, the court found she had a clear intention to desert, and granted the husband a divorce. Supervening desertion occurs when spouses initially separate physically but intend to reunite, but later one develops an intention to desert instead.
