Section 144 of the CrPC allows an executive magistrate to restrict public gatherings or impose curfews if they believe there is a threat of danger to human life or safety. However, the Supreme Court has held that restrictions must meet the test of proportionality and can only be imposed if there is an imminent threat backed by material evidence.
