Petitioner Angelina Gue filed for a judicial declaration of the presumptive death of her husband Willian Gue who left for Shanghai, China in 1946 and had not been heard from since. The trial court dismissed the petition finding that Angelina did not have a right upon which a judicial decree could be based. The Court affirmed, citing precedent that a petition for presumptive death requires a right to be enforced or remedy to be determined, which was not present here since the couple did not acquire property
