1) Encarnacion owned a house that he leased to Baldomar on a month-to-month basis for 6 years at P35 per month. 2) After Manila was liberated, Encarnacion notified Baldomar to vacate by April 15, 1945 as he needed the house for his offices destroyed in the war. 3) Despite the notice, Baldomar insisted on continuing occupancy, claiming the contract allowed indefinite occupancy. The Court disagreed, finding the month-to-month lease did not authorize indefinite occupancy at Baldomar
