The developer Marvel Omega Builders sold a villa to Mr. Shrihari Gokhale in 2012 with the promise to deliver possession by 2014. However, possession was not delivered on time. The NCDRC ordered the developer to refund Rs. 8.14 crore plus 10% interest to the buyer. The Supreme Court upheld this order, observing that buyers are justified in refusing possession after unreasonable delay by builders. The court also directed that the property remain attached until the order was fully complied with.
