What is Quezon City Cemetery Ordinance Review about?
The Quezon City council enacted an ordinance requiring private cemeteries to set aside at least 6% of their total area for the charity burial of pauper residents. Himlayang Pilipino cemetery challenged this provision. The Supreme Court ruled the provision was an unconstitutional confiscation of private property without compensation. Police power allows regulation of private property but not outright confiscation. There was no reasonable relation between the land confiscation and promotion of public welfare.
