The labor union IBM-Local 31 was the bargaining agent for GMC employees. The CBA contained provisions requiring union membership. Casio was the union president but was expelled by other officers. The union requested GMC terminate Casio due to the expulsion. GMC did so without allowing Casio to respond to the charges. The Court of Appeals found this violated due process. The Supreme Court agreed, as Casio was not given a chance to defend himself against the union
