What is Tender of Payment in Contract Dispute about?

The petitioner failed to pay amortization payments on a contract to sell a house and lot. While the petitioner claimed willingness to pay, no actual payment was made. The Supreme Court ruled that tender of payment without actual payment or consignment does not discharge the obligation. The petitioner was liable for interest from the date of default until full payment. However, the contract remained valid and subsisting since the cancellation was not properly effected under the Maceda Law.
