The Supreme Court ruled that Sangguniang Kabataan elections are not considered "regular local elections" for purposes of a recall proceeding under the Local Government Code. The Code allows for recall elections of local officials to be held any time except within one year before a regular local election. Considering SK elections as regular would render recall provisions ineffective. The Court found the intent was for regular elections to refer only to those where the office being recalled is up for contest.
