About this document

Key Elements of Criminal Liability by Kelly Vanda is a document available to read on EtoBox.

To establish that a crime has occurred, four necessary elements must be present: 1) an actus reus, defined as a voluntary physical act, 2) mens rea, or a culpable mental state, 3) a causal connection between the act and mental state, and 4) a harmful result. Additionally, for an act to satisfy the requirement of actus reus, it must be voluntary and cause some social harm. Certain factors like unconsciousness or coercion can render an act involuntary and prevent criminal liability.
