What is Palmares v. CA: Suretyship Liability about?

Palmares co-signed a loan for Sps. Azarraga from MB Lending. When Sps. Azarraga defaulted on the loan, MB Lending sued Palmares as the sole defendant. The Court of Appeals found that Palmares was a surety rather than a guarantor because she expressly agreed to be jointly and severally liable for the loan. As a surety, Palmares was primarily liable for the debt even without demand on the principal debtors. The Supreme Court affirmed, finding multiple factors supporting Palmares
