Any employee, whether contractual or probationary, who has worked in an establishment for at least 80 days in the 12 months preceding the expected delivery date is entitled to maternity benefits, including maternity leave without pay. This includes an anganwadi worker who took 10 weeks of unapproved leave and a hospital employee, even if the hospital employs only 10 people. However, maternity benefits do not cover many women working in the large unorganized sector.
