What is Practice Makes ... Pragmatic: Designing a Practical Smart Contract Legal Architecture about?

Much of the research and analysis relating to smart legal contracts has had a focus on what a ‘smart legal contract’ could be, the manner in which code and natural language could be combined, and how important contractual legal principles could be determined for a legally-binding contract represented in a combination of digital and analogue forms. This chapter seeks to complement the theoretical approach taken in some of this work by identifying and summarizing key issues which have arisen in designing the legal architecture for smart contracts as a matter of practice. The issues discussed are interoperability, certainty, flexibility, accountability, and safety. This article also offers some possible pragmatic ways in which these issues can be managed.
