A naturalized Canadian citizen obtained a divorce decree from a Canadian court dissolving his marriage to a Filipina. He later wanted to remarry another Filipina in the Philippines. However, Article 40 of the Family Code states that the absolute nullity of a previous marriage may be invoked for purposes of remarriage on the basis solely of a final judgment declaring such marriage void issued by a Philippine court.
