The Supreme Court ruled that the Commission on Elections (Comelec) gravely abused its discretion in denying the substitution of Olivia as the candidate to replace Kimberly. The Comelec has a ministerial duty to receive certificates of candidacy. Kimberly was a validly nominated candidate that could be substituted under the law. Olivia complied with all the requirements to validly substitute for Kimberly. The Comelec cannot cancel a certificate of candidacy without proper proceedings.
