Clark-Fontana Paint Company supplied paint to a subcontractor, Elmore Decorators, for a construction project but was not fully paid. Clark-Fontana endorsed joint checks from the general contractor, Glassman Construction, that were meant to pay Clark-Fontana and the subcontractor. Glassman argued Clark-Fontana waived its right to further payment under the Miller Act by endorsing the checks. The court found the endorsements did not constitute a clear waiver and that Clark-Fontana was not required to deduct it
