What is Mortgagee about?
The letter from the mortgagee informing the mortgagor of their intent to foreclose is not considered an actual foreclosure of the chattel. A mere offer by the mortgagor to surrender the item, if not accepted by the mortgagee, does not prevent the mortgagee from suing to recover the remaining balance of the purchase price, according to a 1977 Supreme Court case.
