The Supreme Court ruled that FedEx was not liable to pay damages to American Home Assurance (AHAC) and Philam Insurance. [1] AHAC had paid Smithkline Beecham for damaged veterinary vaccines shipped by FedEx after Smithkline filed an insurance claim. [2] However, AHAC and Philam did not have a right to subrogation or cause of action against FedEx because they did not provide the required written notice of their claim within 14 days as stipulated in FedEx
