The Supreme Court ruled that a waiver of Article 125 of the RPC, which requires arrested persons to be delivered to judicial authorities within a set time period, does not give the state the right to detain someone indefinitely. The waiver only extends detention for the maximum 15 or 30 day period for preliminary investigation under the Rules of Court.
