About this document
Stone v. Graham: Establishment Clause Ruling by Gail Cariño is a document available to read on EtoBox.
The Supreme Court ruled that a Kentucky statute requiring the posting of the Ten Commandments in public classrooms violated the Establishment Clause. Under the Lemon test, the statute was found to fail the first prong by not having a clear secular purpose. While the state claimed an educational purpose, the Court determined the actual purpose was religious in nature. Displaying the religious text showed impermissible state endorsement of religion. The statute was therefore unconstitutional.
