The Supreme Court ruled that the Sandiganbayan erred in dismissing criminal charges against respondent Henry Go for alleged violations of the Anti-Graft and Corrupt Practices Act. While Go is a private person, he can still be prosecuted for conspiracy with the now deceased public official Arturo Enrile, as the death did not extinguish the alleged crime nor remove the basis for the conspiracy charge.
