What is Fajardo Case: Invalid Building Permit Ordinance about?

Fajardo and Babilonia were charged with violating an ordinance that required a permit from the mayor to construct a building. The ordinance gave unlimited discretion to the mayor to deny permits. Fajardo and Babilonia constructed a building without a permit after their previous home was destroyed by a typhoon. The court found the ordinance to be an arbitrary and unlimited conferment of power without standards, and therefore not a valid exercise of police power.
