EYIS and Shen Dar both claimed rights to register the trademark "VESPA" for air compressors. While Shen Dar filed an application before EYIS in 1997, EYIS was able to show it was the prior user of the mark on air compressors imported from Shen Dar between 1997-2004. The air compressors imported by EYIS were actually marked "SD" not "VESPA". Therefore, the Court ruled that mere earlier filing does not establish ownership under trademark law, and that EYIS was the rightful owner as the prior user of the mark
