Ernesto Garces was accused of being an accessory to the rape of AAA by Pacursa. The court found that Garces was present when Pacursa abducted AAA and brought her to a tobacco barn. Garces then positioned himself outside as a lookout. When shouts were heard, Garces entered the barn and dragged AAA away from Pacursa. The Supreme Court ruled that Garces was an accomplice to the rape, rather than merely an accessory, because he knew of and cooperated in Pacursa
