BPI Family Savings Bank v Golden Power Diesel. 1994, CEDEC Transport mortgaged certain property to secure a loan (6.5M) in favour of BPI. Later, it obtained 2.1M and 1.1M loans using the same properties. In 1998, BPI sought to foreclose extrajudicially the real estate mortgage. In 2002, Golden Power Diesel and Renato Tan filed a motion to hold the implementation of the writ alleging that they are in possession of the properties.
