The Supreme Court of New Hampshire modified its previous opinion in Case No. 99-296 regarding whether the distribution and sale of water was incidental and subordinate to the permitted use of water storage facilities. The court replaced the words "related to and dependent upon" with the words "incidental and subordinate to" in the last paragraph of the majority opinion. The motion for rehearing and reconsideration was otherwise denied.
