Paulo Jackson Polangcos was convicted of possession of illegal drugs based on evidence found during a search by police officer SPO2 Juanilla. However, Polangcos was initially stopped for lack of a license plate on his motorcycle, which is punishable by a fine rather than imprisonment. As such, there were no legal grounds for an arrest and search. Both the trial court and appellate court erred in admitting the evidence and convicting Polangcos, as any evidence obtained from an illegal search is inadmissible.
